1. Introduction

Fa'aliyati is a digital technology platform that enables the creation and management of invitations and events, the management of invitees, attendance tracking, and the provision of digital tools related to occasions and events. By using the platform, creating an account, purchasing any subscription, or using any of its services, the user agrees to be bound by these Terms and Conditions and the Privacy Policy.

2. Nature of the Service

Fa'aliyati is a technology service provider only. The platform is not an event organizer, a party to any event, or responsible for its management, success, or outcomes. All decisions relating to events, guests, content, and operational procedures rest solely with the user.

3. Eligibility

The user acknowledges that they:

  • Have the necessary legal capacity.
  • Hold the legal right to use the data they upload or process through the platform.
  • Will use the platform in accordance with applicable laws and regulations.

4. Accounts and Information Security

The user bears full responsibility for:

  • Protecting their login credentials.
  • All activities carried out through their account.
  • Keeping their information accurate and up to date.
  • Maintaining the confidentiality of their account information.

Fa'aliyati bears no responsibility for any unauthorized use resulting from account sharing or negligence in protecting it.

5. User Content

The user alone bears full responsibility for all data and content they upload, share, or publish through the platform. This includes, but is not limited to:

  • Invitee names.
  • Phone numbers.
  • Email addresses.
  • Images.
  • Logos.
  • Text.
  • Links.
  • Files and attachments.

The user undertakes that all content used does not infringe any third-party rights or any applicable laws or regulations.

6. Invitee Data

The user acknowledges that they:

  • Obtained the invitees’ data lawfully.
  • Hold the legal right to use it.
  • Bear full responsibility for collecting, processing, and using it.

Fa'aliyati bears no responsibility for any complaint, claim, or dispute relating to invitee data or the manner of its collection or use.

7. Invitations and Events

The platform provides technical tools for managing invitations and events only. Fa'aliyati does not guarantee:

  • Invitee attendance.
  • The accuracy of entered data.
  • The success of the event.
  • The completeness of responses.
  • The achievement of any operational, commercial, or organizational outcomes.

The user bears full responsibility for managing their event and making their operational decisions.

8. QR Codes and Attendance Management

The platform provides technical tools for managing entry and attendance. Fa'aliyati bears no responsibility for:

  • Misuse of QR codes.
  • Sharing of codes by users or invitees.
  • Data-entry errors.
  • Failures caused by devices, networks, or service providers.

9. RSVP Responses

The platform provides tools for recording invitees’ confirmations or apologies. Fa'aliyati does not guarantee:

  • The accuracy of responses.
  • That invitees will honor their responses.
  • That responses will match actual attendance.

10. Subscriptions and Paid Services

Subscriptions and plans are subject to the prices announced at the time of purchase. Fa'aliyati may modify prices, plans, or features in the future as it deems appropriate. Such modifications do not affect an existing paid subscription until the end of its current term, unless otherwise stated.

11. Refund Policy

Unless otherwise stated in writing:

  • Subscription and service fees are considered final.
  • The user is not entitled to claim a refund after the service has been activated or its use has begun.
  • The platform may process exceptional refund requests at its discretion and in accordance with applicable laws.

12. Custom Services

Custom services — including enterprise services, event management and operation, or bespoke solutions — are subject to separate quotations and agreements, and may be governed by additional terms that differ from those of standard subscriptions.

13. Prohibited Use

The user is prohibited from:

  • Circumventing plan limits.
  • Attempting to bypass technical controls.
  • Conducting penetration testing without written authorization.
  • Using automated tools to scrape data.
  • Publishing unlawful, abusive, or fraudulent content.
  • Using the platform for unlawful purposes.

14. Intellectual Property

All rights relating to the platform — including software, designs, logos, trademarks, databases, and platform-owned content — remain the exclusive property of Fa'aliyati or its licensors.

15. Third-Party Services

The platform may rely on services provided by third parties, such as hosting, payment, messaging, login, or technical integration services. Fa'aliyati bears no responsibility for:

  • The failure of those services.
  • Their discontinuation.
  • Changes to their policies.
  • Data loss resulting from them.
  • Any damages or losses arising from their use.

16. Availability and Maintenance

Fa'aliyati strives to provide its services reliably, but does not guarantee continuous, uninterrupted availability. The platform may carry out maintenance, updates, development, or temporary suspension of services when needed.

17. Data Retention and Deletion

Fa'aliyati strives to provide its services with the highest possible reliability; however, the platform does not guarantee permanent or unlimited retention of data, files, invitations, designs, or event or invitee records. The user acknowledges and agrees that:

  • The platform is not a permanent archiving or backup service.
  • Some data, files, invitations, designs, or event records may be deleted, archived, or have their access restricted after periods determined by the platform, or for operational, technical, or security reasons.
  • It is the user’s responsibility to download and save any content, data, or files they wish to retain.
  • Fa'aliyati does not guarantee that any data, files, invitations, or records will remain available permanently or indefinitely.

In the event of loss, deletion, corruption, or unavailability of any data, files, invitations, designs, or event, invitee, or attendance records, the user acknowledges that the platform is not obligated to retain such data permanently, and Fa'aliyati bears no responsibility for any losses, damages, or claims arising therefrom.

18. Account Suspension or Termination

Fa'aliyati may suspend, restrict, deactivate, or delete any account upon a breach of these Terms, misuse of the platform, violation of laws, or any attempt to circumvent the systems or plans.

19. Limitation of Liability

To the maximum extent permitted by law, Fa'aliyati, its owner, employees, partners, representatives, or service providers shall bear no liability for:

  • Loss of profits or revenue.
  • Loss of business or customers.
  • Loss of data or files.
  • Loss of invitations, designs, or attendance or invitee records.
  • Lost opportunities.
  • Indirect, incidental, or consequential damages.
  • Any damages or losses arising from the use of, or inability to use, the platform.

In all cases, Fa'aliyati's total liability to the user shall not exceed the amounts paid by the user to the platform during the twelve (12) months preceding the disputed claim.

20. Indemnification

The user agrees to indemnify and hold harmless Fa'aliyati, its owner, directors, employees, partners, and representatives from any claims, lawsuits, losses, damages, fines, fees, or legal costs arising from:

  • Use of the platform.
  • Breach of these Terms.
  • Infringement of third-party rights.
  • The data or content uploaded by the user.
  • The use of invitee data.

21. Force Majeure

Fa'aliyati bears no responsibility for any delay or failure resulting from circumstances beyond its reasonable control, including natural disasters, technical failures, internet outages, cyberattacks, government decisions, or service-provider disruptions.

22. Amendments

Fa'aliyati may amend these Terms or the Privacy Policy at any time. Continued use of the platform after the amendments are published constitutes acceptance of those amendments.

23. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. The courts of the Emirate of Abu Dhabi shall have jurisdiction over any dispute relating to these Terms or to the use of the platform, unless the law requires otherwise.
